A herniated disc or a condition called foraminal stenosis can cause a pinching of a nerve in your spine, which results in pain radiating down one or both arms. This can make it difficult to use your hands. Your neck condition can also cause frequent, severe headaches or migraines headaches.
YOU CAN QUALIFY FOR DISABILITY ON THE BASIS OF YOUR NECK PAIN IN ONE OF TWO WAYS:
- First, your neck arthritis may be so severe that it meets the Social Security Administration’s Listing of Impairments for neck pain. In order to qualify for disability benefits under the Listing of Impairments for neck arthritis there must be evidence of the following: nerve damage, limited motion of the neck, and motor loss with sensory or reflex loss. Or you have a painful condition called Spinal arachnoiditis, which results in pain and burning and the need to change position more than once every 2 hours. In order to qualify for these specific Listing of Impairments for neck pain you must have certain medical findings. It is important to hire an experienced lawyer who knows what to be looking for when reviewing your case.
- Second, you may qualify for disability benefits due to your back pain if it prevents you from working. If you are under 50 years old, you must prove that your neck pain prevents you from performing a job requiring you to sit most of the day and to lift up to 10 pounds. There are special rules for those age 50 and age 55.
