We understand the legal and personal issues at stake, and provide solid guidance and solutions in the most difficult situations.
For many people, a divorce is one of the most important personal, financial, and emotional decisions they will ever make. When individuals dissolve their marriage, they have to make critical long term decisions about their children, home, property and business interests, and debts.
A non-parental custody action (or third party custody action) is one brought by individuals who are seeking legal custody of a child of whom they are not a parent.
When a child support agreement or order is made at the time of the divorce, there is the assumption that child support will likely need to be adjusted or modified in the future as the child gets older and situations change.
SAME-SEX MARRIAGES AND DOMESTIC PARTNERSHIPS
Washington has both a Domestic Partnership law and legal same-sex marriage equality. These are not the same thing, and particularly as it relates to same sex marriage, there are still special legal problems that may arise for same sex spouses/couples that are not issues in traditional marriages.
RELOCATION WITH CHILDREN
When parents are subject to a parenting plan/residential schedule for their children (in Washington State), there is standard language in that order addressing the requirements a primary residential parent needs to follow in order to relocate outside the child’s current school district (or further) with the child.
MODIFICATION OF PARENTING PLANS
When a parenting plan is finalized by agreement or a court decision, formal modification of that parenting plan requires court action. Unless changes to the parenting plan are agreed, Washington courts tend to highly favor the provisions in the original parenting plan, and therefore, absent agreement, certain legal standards must be met before a parenting plan modification case can move forward.
Post Secondary Support refers to support paid by parents for their adult children who are still dependent because they are attending college and seeking a degree or training for a trade (absent a support order that has already addressed it this issue).
